REGISTERED MEMBER PASSWORDS / ACCOUNT ACCESS
If you are a Registered Member, you are responsible for maintaining the confidentiality of your password and account, and are fully responsible for all activities that occur under your password or account with or without your knowledge. You may change your password at any time by updating your profile on the applicable Website. You agree to immediately notify EMEDIA of any unauthorized use of your password or account or any other breach of security. EMEDIA cannot and will not be liable, directly or indirectly, for any loss or damage arising from your failure to comply with this section.
As a Registered Member, you agree that EMEDIA may, in its sole discretion, immediately terminate your EMEDIA account and access to the Website without prior notice. Without limiting the foregoing, the following will lead to a termination by EMEDIA of your use of the Website: (a) breaches or violations of these TERMS OF USE or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) unexpected technical issues or problems, and (e) extended periods of inactivity. Further your EMEDIA account may be deleted and your membership may be terminated without warning, if we believe that you are under 13 years of age.
Termination of a Registered Member account includes removal of access to all offerings within the Website and may also bar you from further use of the Website. You understand that such termination may result in permanent loss of all information and content associated with your account. Consequently, you should maintain your own copies of all of your information and content. Furthermore, you agree that EMEDIA shall not be liable to you nor any third-party for any termination of your account or access to the Website.

We refer to the ideas, suggestions, opinions, comments, observations and recommendations about any issue (including about the quality, appropriateness of any use, price, description or other information about any good, which includes any materials or content, and service), and including all text, data, photographs, video, music, sound, chat, messages, blogs, files and any other material provided to us by EMEDIA Visitors and Registered Members as "User Content."
The following rules of conduct apply to your use of the Website and to any and all User Content you post on EMEDIA. EMEDIA reserves the right, in its sole discretion, to terminate a Registered Member's account, investigate and take appropriate legal action, and delete any or all of your User Content.

USER CONTENT
The interactive nature of the Website makes it impossible for us to assume responsibility for any of the User Content that may be accessible to Visitors or Registered Members, or otherwise may be publicly displayed or copied. Similarly, no EMEDIA Content is endorsed by EMEDIA, we make no guarantee regarding the reliability, accuracy, or quality of any User Content. MEMBER DISPUTES
You are solely responsible for your interactions with other EMEDIA users. EMEDIA reserves the right, but has no obligation, to monitor disputes between you and other Visitors or Registered Members. You agree to cooperate with EMEDIA should EMEDIA notify you that it has elected to exercise this right to monitor a dispute.
DISPUTES
If there is any dispute about or involving the Website, you agree that the dispute shall be governed by the laws of the Province of Ontario, Canada, without regard to conflict of law provisions and you agree to exclusive personal jurisdiction and venue in the Province of Ontario.
If EMEDIA does take any legal action against you as a result of your violation of these Terms of Use, EMEDIA will be entitled to recover from you, and you agree to pay, all reasonable attorneys' fees and costs of such action, in addition to any other relief granted to EMEDIA.
DEALINGS WITH THIRD PARTIES
You acknowledge and agree that your correspondence or business dealings with any third parties, including any merchants or advertisers, found on, or through, a Website or any of the Services, including payment for and delivery of related goods and services, and all other terms, conditions, representations and warranties related to such dealings, are solely between you and such third parties. EMEDIA assumes no responsibility whatsoever for any charges you or any user of your account incurs when making purchases or other transactions in this manner. Further, the responsibility for ensuring compliance with all applicable laws in connection with any such transactions will be yours alone. You agree that EMEDIA will not be responsible or liable in any way for any loss or damage of any kind incurred as a result of, or in connection with, any such dealings or transactions.

This Agreement constitutes the entire agreement between you and EMEDIA regarding the use of the Website. The failure of EMEDIA to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision. This Agreement operates to the fullest extent permissible by law. You don't need to have a fileplanet subscription anymore - they opened it up to all registered users of fileplanet. Good luck though - I've been downloading it since monday and teh 12 Gig file is still going...Only thing worse than a 12 Gig file coming through at 40k/s is when it gets a "Network Error" and you have to "click to retry" but of course this happens at night and you miss 5 hours of downloading... They say that it sucks anyways, even if you CAN get it to load and run for more than 10 min, the "worse than Vanguard" bugginess makes a crappy game look hopeless...
